TERMS AND CONDITIONS OF USE

ARTICLE 1 - Purpose

The merchant website https://www.decoration-dautrefois.com/en/ (hereinafter the " Website "is to enable sales between non-professional buyers (the " Customers (hereinafter referred to as the "seller") via the Internet with the professional seller FRANCE DECO (hereinafter referred to as the "seller") Sales ") to enable Customers to purchase home furnishings and decorative items (the " Products ").
The present Terms and Conditions of Use (the " CGU "These terms define the conditions under which the Vendor's site provides Customers with the technological tools enabling them to order the Products offered for sale.
They supplement the General Terms and Conditions of Sale, which govern sales between Customers and the Vendor via the website, and must be accepted by the Customer in order to use the services offered by the Vendor, by means of validation when registering on the website.

ARTICLE 2- Scope of application

These GCU apply, without restriction or reservation, to the use of the services and technological tools made available to Customers by the Site.
These tools enable Customers to register on the Site and order Products, pay for them, receive confirmation and communicate with the Seller if necessary.
These GCU are accessible at all times on the Site and will prevail, if necessary, over any other version or any other contradictory document.
As these GCU may be subject to subsequent modifications, the version applicable to the Customer's purchase is that in force on the website on the date the order is placed.

ARTICLE 3 - Services offered by the site

Access to the site is strictly reserved for non-professional Customers acting on a private basis, which the Customer declares and acknowledges when using the site's services, and furthermore undertakes to carry out in good faith all purchasing operations concluded with FRANCE DECO.
Use of the Site is free for Customers (excluding any connection costs charged by the operator) and without obligation to purchase.

Information on this site may contain technical inaccuracies or typographical errors.
Customers who wish to place an Order and create a personal account via the Site are asked to provide strictly confidential and personal identifiers and passwords.

The customer undertakes to keep these codes confidential and not to divulge them to any person whatsoever.
The customer is solely responsible for the use of these codes and access to the site, unless there is proof of fraudulent use for which the customer cannot be held responsible.
FRANCE DECO must be immediately notified in writing of any fraudulent use of these codes of which the Customer is aware.

ARTICLE 4 - Protection of personal data

Pursuant to Law 78-17 of January 6, 1978 amended by Law No. 2018-493 of June 20, 2018, it is reminded that the personal data requested from the Customer by FRANCE DECO is necessary, to guarantee the Customer the placing of orders and the processing of their orders.
This data is communicated to FRANCE DECO in order to enable it to proceed with the execution of the order and its delivery to the address provided by the Customer. Under no circumstances may it be used for any other purpose.
FRANCE DECO is committed to ensuring the security of the personal data it stores for the purposes of fulfilling and tracking orders. The processing of information communicated via the Site complies with legal requirements concerning the protection of personal data, and the information system used ensures optimum protection of this data.
In accordance with current national and European regulations, the customer has a permanent right of access, modification, rectification, opposition, portability and limitation of the processing of information concerning him or her.
This right may be exercised under the terms and conditions defined by the Vendor, by contacting him via the email address.

ARTICLE 5 - Intellectual property

5.1 Property intellectual  
The content of the Site is the property of the Vendor and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

5.2Newsletter
By ticking the box provided for this purpose or by expressly agreeing to this, the User accepts that FRANCE DECO may send him/her, at a frequency and in a form determined by FRANCE DECO, a newsletter which may contain information relating to its activity.
They will be able to unsubscribe from the newsletter by clicking on the link provided for this purpose in each newsletter.

5.4 Do not call list
The User has the option of registering free of charge on a BLOCTEL (www.bloctel.gouv.fr) in order to no longer be canvassed by telephone by a professional with whom they have no current contractual relationship, in accordance with French consumer law no. 2014-344 of March 17, 2014.

ARTICLE 6 - Responsibilities

FRANCE DECO's liability towards the Customer can only be engaged for facts which are directly attributable to FRANCE DECO and which cause the Customer a direct prejudice, to the exclusion of any indirect prejudice.
FRANCE DECO shall not be held liable for any misuse of the Site's services by the Customer or for any fault on the Customer's part. FRANCE DECO shall not be held liable for facts attributable to a third party.
The Customer is solely responsible for the use of the site's services, and undertakes to guarantee at first request, to indemnify and compensate FRANCE DECO for any damage, loss, loss of profit, that it may suffer if its responsibility is engaged by a third party, due to an action related to this use by the Customer.

ARTICLE 7 - Partial nullity

If one or more of the stipulations herein are held to be invalid or declared as such in application of a law, regulation or final decision of a competent court, the other stipulations shall retain all their force and scope.

ARTICLE 8 - Applicable law

These General Terms and Conditions of Use and any transactions arising therefrom are governed by French law.
They are written in French. Should they be translated into one or more languages, only the French text will be deemed authentic in the event of a dispute.

ARTICLE 9 - Customer acceptance

The fact that a Customer places an order on the Site implies full acceptance of these General Terms and Conditions of Sale, which is expressly recognized by the Customer, who waives, in particular, the right to invoke any contradictory document which would be unenforceable against FRANCE DECO.

ARTICLE 11 - Disputes

Any dispute relating to the interpretation and/or execution of these GCU shall be subject to French jurisdiction.
Complaints should be sent via the contact form available on the Site.
It is reminded that any dispute or claim concerning the sale, description or delivery of the Products must be settled directly between the Customer and FRANCE DECO.
The Customer is informed that he may in any event have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation (art. L 612-1 C. consom.) or with the existing sectoral mediation bodies, the references of which appear on the General Terms and Conditions of Sale, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute, the contact details of which are given in the Vendor's General Terms and Conditions of Sale.
